The purpose of the deployment is to facilitate those who enjoy watching rail operations to be able to pursue their interest remotely without having to visit sites in person.
The lawful basis under Article 6 UK GDPR is:
“(f) processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.”
The legitimate interests being pursued in this case are the provision of the Railcam service to subscribers and others with an interest in railway operations and the promotion of the ELR and its surrounding environment.
The processing will not involve special category data.

In addition, it is recognised that third party persons’ data may be inadvertently processed as those persons pass by outside the ELR boundary within the field of view of a camera or are referred to in conversations detected by a microphone.
Webcam viewers on the Railcam UK website and on the ELR website (via YouTube).
The data is broadcast via livestream technology and is not retained or further processed.
Individuals have the right to request data in respect of them, which is held as part of this scheme. However, since video footage is not retained, there is no data held.
